matrimonial regimes
Primary plan - Household debts - Family housing - Legal regime - Assets - Liabilities - Liquidation - PACS - Cohabitation
After an introduction recalling the evolution of matrimonial property law from Rome, the course is divided into three parts. The first part describes the primary matrimonial regime, imperative for any married couple, by tracing the household obligations (stewardship and housing), while explaining the necessary measures in the event of a marital crisis. A second part describes the rules applicable to secondary matrimonial regimes, among which the married couple must make their choice. As such, a longer development is attached to the suppletive legal regime, that of the community reduced to acquests, through the study of its life (composition of the patrimony, management of the patrimony) and its end (dissolution and regulation). A narrower focus is on conventional schemes (their choices, their types) because they are statistically minor. Finally, the last part attempts to explain, broadly, the regime attached to couples out of wedlock: partners and cohabitants.
